A McAllen woman is seeking a lawsuit against a custom car dealership.
According to Amanda Gomez, Joe Hernandez, owner of Top Kustomz Car Shop in McAllen, took thousands of dollars from her and did not do the work she was hired to do.
Gomez bought a blue truck in May. He hired Hernandez to lift the truck and add new tires and rims – a job totaling $14,500.
“Everything was custom made, so he asked for an advance payment so he could go and buy everything,” Gomez said. “I gave him a salary, I started paying him on May 26, and I believe the last payment was around June six or seven.”
After two months passed, Gomez says Hernandez told her to take his truck down to his store.
“He took my truck, he took my truck for a week and a half,” said Gomez. “Then they said, ‘I’m going to take it to this place, they’re going to take care of everything for us.'”
According to Gomez, he tracked down his truck and found it hadn’t been moved from Top Kustomz in over a week.
According to Gomez, when he contacted Hernandez about it, he ended up moving the truck to another shop where the work needed to be done.
“I went there and I was sitting in the back, so I asked the owner, and he said ‘he hasn’t paid for the work, he hasn’t brought any of the parts. to do he always told us. “I will bring him without bringing anything,” said Gomez.
At that point, apparently on the run, Gomez returned his truck and demanded full payment from Hernandez, who told him no.
“I don’t have a refund agreement under all the loans I make,” Hernandez said.
According to Gomez, she tried to get her money back, and then Hernandez agreed to pay her back.
Hernandez said the money was sent, but Gomez says he never received it.
“He also said. ‘I sent the whole $14,000 through QuickBooks and you got an email to tell you how you want to get the money’ I was like, ‘no what’s going on but it’s good,'” Gomez said.
The money never reached Gomez.
Channel 5 reached out to Hernandez, who said he would give Gomez the money, but not if the story was released.
“What he’s trying to do is probably make me feel bad,” Hernandez said.
Gomez has been waiting three weeks for Hernandez to pay her, but as of today, she has not been paid.
“How do you treat someone,” Gomez said. “I’m out of all this money, and you’ve been alive for the last two months.”
Channel 5 reached out to Hernandez to ask what the holdup was.
Hernandez told Channel 5 that he wanted Gomez to sign a notarized form saying he had received his full refund, but Gomez did not sign until he saw the money.
“I mean what’s the rush here, I think about the rush because he wants something and I’m going to get it, it’s not my fault, I don’t care,” Hernandez said.
A check was eventually issued, but Gomez says the check bounced because the account was closed.
Hernandez says he has a new account and is willing to write another check, but Gomez is satisfied.
Gomez is working with the Hidalgo County District Attorney’s Office to explore legal options.
