BAY CITY, MI – A Bay City teenager is facing adult charges after allegedly shooting a fellow teenager in the head with a stolen gun.
At 10:20 a.m. Oct. 22, police responded to the 200 block of South Sherman Street for a report of a shooting. A girl who called 911 said another girl had been shot in the head and the shooter had already fled, according to police reports in court documents.
15-year-old resident Aubreanna K. Police entered the home to find Anderson on the floor of a bedroom, with a handgun magazine nearby. Anderson was unable to communicate as he was taken to the emergency room at McLaren Bay Region. She was stabilized on a ventilator there before being transferred to Covenant Healthcare in Saginaw and later transferred to Spectrum Butterworth Hospital in Grand Rapids.
Doctors discovered that a bullet had passed through Anderson’s parietal lobe.
During their investigation, police discovered that Anderson and four other teenagers had been at her home that morning. One of the three teenagers told police he and his friends went to the house at Anderson’s invitation.
As they hung out in her bedroom, Ernest J. Olivo brandished a .40-caliber handgun, the witness said.
“Ernest was walking around with a gun,” the witness told police. “He was swinging it around. He was trying to scare O’Briana.
Olivo and Anderson were previously in a dating relationship and used to fight, the witness said. Olivo and Anderson were sitting on her bed when the gun went off, the witness said. Then the three children ran away from the house.
At 4:45 p.m. that same day, Olivo’s parents brought him to the Bay County Law Enforcement Center. The teenager’s father told police his son told him he and his friends found a gun and that the gun “went off” while they were sitting on Anderson’s bed. He added that his son had never been around a gun.
In an interview by police, Olivo initially said he had found the gun the night before in the middle of Center Avenue. He said he never pointed it at Anderson and never meant to hurt her.
“I never meant to shoot her,” he told police, according to their reports. “I was just kidding. When I got the gun, I said, ‘Boy, you stop playing with me’. I didn’t pull the trigger. I don’t know how it went. “
Olivo later said he got the gun while driving around in an unlocked car and found it in the glovebox, according to police reports.
Officers arrested Olivo and booked him into the Bay County Juvenile Home in Hampton Township.
Olivo later pleaded guilty in Bay County District Court to three felony firearms charges in addition to discharging a firearm into or into a building, assault with intent to do great bodily harm, and receiving and concealing a stolen firearm. The first offense is a 15-year offense, the second and third are 10-year offences. A felony firearm offense mandates a minimum sentence of two consecutive years in prison with any associated measures.
The judge in question set Olivo’s bond at $100,000 cash bail.
Police recovered the gun from a roof near the General Motors plant on Woodside Avenue, Bay City Public Safety Capt. Nathan Webster said. Webster said the suspect threw it onto the roof before surrendering to police.
Olivo is represented by Saginaw attorney Alan A. Crawford. When contacted by MLive, he declined to comment on the matter, saying he was still in the early stages of familiarizing himself with the details.
Anderson’s aunt, Melina Acosta, has started a GoFundMe campaign to help with her niece’s medical expenses and her family’s fuel, food and travel expenses. As of 11:50 a.m. on Monday, October 31, $1,770 had been raised from 42 donors.
Olivo is scheduled to appear for the preliminary exam on November 10 at 2 p.m.
