Guwahati: The previously appointed 200-plus Foreign Tribunal (FT) members to primarily handle cases related to the National Register of Citizens (NRC) will soon move the Supreme Court against the Assam government’s decision to not extended their service beyond September. 23 this year.
The notification signed by the Assam Home Department Commissioner and Diganta Bara Secretary on October 14 stated that the additional members who were serving in the Foreign Courts have been removed from duty, with effect from September 23. At that time, the question arose about the validity of the sentences given by these members. attached between September 23 and October 14.
Also, it caused these members to be upset about the manner in which they were removed from office and some of them are preparing to go to the Supreme Court against the government notification.
Notably, the Foreigners’ Tribunal (FT) is a judicial body which means that a member of the FT has the same title as a judge. In addition to the regular 100 FTs, the Assam government has appointed practicing lawyers, retired civil servants, and judicial officers for an additional 200 FTs soon after the final draft of the NRC was published in August 2019.
These additional FTs are believed to be handling the cases of 19.06 lakh people who have been removed from the NRC list.
Now, termination of services of additional FT members has also clouded the update of NRC in Assam on which Rs 1,600 crore of government money has been spent.
In private, one member of the FT told IANS that the government used the word ‘lala’ while issuing their eviction notice which was insulting.
He said that according to the Civil Service Regulations, the word ‘Forfeiture’ cannot be used to fire someone. If this term is used specifically, then the person concerned should first be charged and investigated. After that, if found guilty, ‘deportation’ can be imposed. Moreover, since these members were selected as per the order of the Supreme Court, the government cannot ‘lose’ their tenure.
In another case related to the Foreign Court, an objection was raised before the Gauhati High Court regarding the word ‘loss’ used in the government’s notification on Wednesday. Responding to this, Additional State Attorney D. Majumder said that if inappropriate words were used in the October 14 notification, it can be corrected but it will take time.
Meanwhile, the members will approach the Supreme Court challenging the entire government notification which has put a question mark on the NRC exercise as well.
