After the recent arrest of three police officers, three doctors and a judge for allegedly shielding a man accused of raping and killing a minor, the Assam government has decided to reopen all cases of unnatural death. not involved in housing assistance in the past year.
Chief Minister Himanta Biswa Sarma said on Friday that the decision was taken at a meeting of senior police officers after an inquest into the death of a 13-year-old girl in June revealed how senior police officers, government doctors and the judge were at odds. followed the project. rape and murder as suicide.
“In Assam, there have already been cases of rape and murder of domestic help. We will try and take all such cases to the logical end. We have requested all district police chiefs to reopen and re-investigate. all such cases occurred in the last year,” the CM said at a press conference in Guwahati.
Sarma said that from now on, if such an incident occurs, the district police chief and the deputy chief will personally go to the crime scene, and the cases will not be closed until they are satisfied with the investigation.
In the case in question, a 13-year-old girl who worked at the home of Sashastra Seema Bal (SSB) Jawan Krishna Kamal Baruah reportedly committed suicide on June 11 in Dhula area of Darrang district. The police have registered a case of unusual death and have started an investigation.
After an autopsy and an inquest by a coroner, the police concluded that it was a case of suicide and the body was buried. The girl’s family members, alleging that she was killed, have filed another case.
The case took a new turn in August when CM Sarma received a WhatsApp message alleging that the case was mishandled. He visited the victim’s family on August 11 and ordered the case to be investigated by the Criminal Investigation Department (CID) of the Assam Police.
“The current case has shown that sometimes, post-mortems and investigations are done as a way to help the accused. I want to send a strong message to the police, doctors and judges to do their duty diligently, especially in these situations there is a gray area,” said Sarma.
The CM said that the state government will bring amendments in laws or prepare standard operating procedures (SOPs) to be followed by the police and other authorities while dealing with cases of rape or murder of minors working as domestic help.
“I receive more than 1,000 messages every day. It was pure luck that I checked this particular message that I received at 2.30 in the morning and decided to visit the victim’s family the next day. Because of the broken evidence, the case was dismissed. submitted to the CID,” said the CM.
“The evidence showed that right from the officer-in-charge of the local police station to the additional superintendent of police to the police chief, doctors and the judge were all involved (in concealing the crime). Now, the courts have to decide.” whether the accused are guilty or not,” he added.
Rejecting the allegations that the current case is tarnishing the image of the police, Sarma said that the arrest of senior police officers, doctors and the magistrate shows that the police do not spare even their own if they are guilty.
Besides Baruah who was arrested on June 30, police recently arrested Darrang’s former superintendent of police Raj Mohan Ray, additional SP Rupan Phukan and sub-inspector Utpal Borah for allegedly raping and killing him after he committed suicide. when they took a number ₹5 lakh from Baru’ah’s family.
A case under sections 120B (criminal conspiracy), 420 (cheating) and 218 (attempt to protect the accused) of the Indian Penal Code (IPC) and two sections of the Prevention of Corruption Act has been filed against them.
The three government doctors at the Mangaldoi civil hospital – Ajanta Bordoloi, Anupam Sharma and Arun Deka – who conducted the post-mortem of the victim and termed it a case of suicide and were hanged on the orders of SI Borah were also arrested last week.
On Friday, the CID arrested Ashirvad Hazarika, a local magistrate who conducted an autopsy on the victim’s body and concluded that her death was due to hanging by the neck. All the accused are now incarcerated.
This case was rare for the police as they had to re-verify the death report and the autopsy and also had to exhume the victim’s body for new forensic tests, DNA testing and a second post-mortem.
“Both, after the initial post-mortem, concluded the death as suicide and said there was no rape though the initial post-mortem report showed the presence of sperm in the underwear of the victim,” said the ADGP ( CID) AYV Krishna.
After the CID took over the case, a new investigation revealed that apart from the main accused, they did not see the girl hanging, and he brought her body down before the police were informed.
“It was when the body was exhumed with the permission of the court and the family members and new examinations by a panel of experts, it was found that the wound on the neck was due to strangulation, there are signs of trauma to her head and DNA tests revealed that the sperm found in her clothes was the main culprit,” said Krishna.
