A suit was filed in the Circuit Court on or about January 28, 2022 in Jefferson County, State of Arkansas, against twelve members of the Quorum Court and Magistrate of Jefferson County seeking assistance and actions related to the disclosure of documents under the Freedom of Information Act.
The Honorable Judge Ben Story issued his decision on September 10, 2022 finding all Defendants in violation of the failure to provide the documents requested by Kimberly Dale and ordering the disclosure of the documents, in addition legal fees and charges are imposed. It’s up there October 26th2022 – Trial Judge awarded Plaintiff legal fees and costs in approx $14,000.00 (13,947.35). Jefferson County will be asked to release these funds to elected officials as a result of the violations. Court records showed that most of the requests were ignored, election officials failed to comply with warnings to respond, and failed to comply with the Communications Decency Act.
Ms. Dale represented the Jefferson County Sheriff in separate lawsuits against members of the Jefferson County Quorum Court and the County Judge for their failure to properly pay detention and jail services and separation of powers relating to the validity of the Acts.
The records sought by the petitioner include several items related to the budget process in 2021. All but one member of the court’s board, Conley Byrd, was named as Defendant in the suit. Not Mr. Byrd in the Defendant’s name, as he agreed to the request made by the Plaintiff.
