ELBURN – An Elburn man has been charged with four felonies for allegedly assaulting a process clerk who was trying to serve him legal documents, according to Elburn police and the court records.
Richard J. House, 50, of the 1400 block of Souders Avenue, Elburn, was charged Oct. 19 with two counts of aggravated battery on a person over 60 and two counts of aggravated battery of aggravated battery to an employer, felony theft of truck keys from an executive officer and felony charges of theft of truck keys and criminal trespass to a vehicle, according to the indictments.
A private investigator providing court documents to House related to an incident in September told police that House assaulted her and took her keys and papers from his truck, according to the report.
The process server “has a mark on his neck that looks like it was placed in his head,” the report says. “There were house scratches on both sides of his neck that looked like bullet wounds.”
House told police he saw the man, now identified as the operator, taking pictures through his window and walked over to his open garage door to take pictures, according to reports.
House watched the man walk back to his truck, then got out to confront him, according to the report.
House told police that the operator “said he had a gun and shot him. House attacked (the operator) in front of his truck,” the report said. “The waiter got back into his truck and Whare reached into the car to grab the papers. Whare grabbed (his) keys that had fallen in his driveway and got back inside. at his home and told his wife to call 911.
The waiter told police he knocked on House’s door to serve him with court documents but House refused to answer, so he left the documents on the curb. door, and described in the door, according to the report.

The waitress told police her keys were in the ignition and the engine was running when House allegedly shot her in the head, the report said.

The detective told police that he was a licensed private investigator with a valid concealed carry permit and that he was armed at the time, but that he did not draw his weapon and did not threaten to use it at the House, the report said.
The House posted $1,000 cash, or 10% of the $10,000 bond set.
The four battery charges are the most serious the House could face, as Class 3 felonies are punishable by two to five years in prison and a fine of up to $25,000 if convicted. will be determined.
Attorney Gary Johnson said he had just become an assistant to the House and could not comment because he had not yet reviewed the details of the case. A message left with a House attorney seeking comment was not returned.
House will next appear in court for a status hearing on Dec. 16, according to court records.
