Warren – Trumbull County Common Pleas Judge Ronald J. Rice ordered the attorney for the Youngstown man charged in the officer-involved shooting to make an appointment with a Columbus-area psychologist to determine his client’s competency.

The shootout happened on June 10 at a busy intersection in Liberty.

Kevin Mallard, 55, of Manhattan Avenue, was in a wheelchair in court Tuesday as his attorney, Eugene Fehr, told the judge that Dr. Robert Stinson said he was willing to test Mallard for eligibility. Fehr said the doctor’s fee is $325 an hour and he won’t charge more than $4,800 for his work.

Rice, who must find Mallard not guilty after receiving the psychologist’s report, scheduled the case’s next hearing for Dec. 13 in anticipation of the report being completed.

Mallard remains in the Trumbull County Jail, held without bond.

A Trumbull County grand jury indicted him last month in a superseded indictment on charges of attempted murder, attempted murder, inducing panic with a firearm, improper handling of a firearm in a motor vehicle, carrying a concealed weapon and three counts of attempted murder with a firearm. .

The new charges stem from an Ohio Bureau of Criminal Investigation report on Mallard’s shootout with Liberty police, who allegedly shot and killed Zach Woods, 20, who stopped in front of Mallard’s car at Liberty Street and Belmont Avenue. On June 10 at about 3 p.m.

Police tried to stop the vehicle Mallard was driving. Officers were reportedly fired upon. The police opened fire, injuring Mallard’s limbs.

Police allege he shot Woods at point-blank range in the temple with a Glock .40-caliber handgun while Woods was behind the wheel of a Mercedes-Benz. Woods suffered serious facial and eye injuries. Witnesses said there was no evidence of road rage at the time.

After the shooting, Mallard walked back to his Humvee, according to the indictment. However, police officers responding to the shooting stopped the Humvee and began a shootout — dozens of shots near the heavily trafficked interchange with Interstate 80 at East Liberty Street.
