How long does it take to execute a Power of Attorney?

Q: My husband and I are considering setting up durable powers of attorney to appoint our son as a real estate and financial attorney. We’ve been procrastinating for the better part of a year now, but someone told us it takes ages to register powers of attorney and you never know what’s around the corner, do you? Can you tell me how long the process will take?

A: As you say, nothing is certain, including how long it will take to register a power of attorney these days, as things are changing from time to time. all. When you first instruct attorneys to prepare a durable power of attorney, they can tell you how long it will take to prepare the necessary forms for you.

It helps if you come to your first meeting with all of your lawyer’s information to hand so that you can send it to your lawyer. A durable power of attorney once written and approved must be signed by three different parties, including the issuer, your certification provider and your attorneys.

A valid power of attorney signed by all parties must be submitted to the public guardian’s office if you wish to have it registered.

It usually takes 12-16 weeks for the public guardian’s office to process the paperwork and issue the registered permanent powers of attorney, however, as of now time, the office of the public defender has said that the time is about 20. week to complete the registration process. Therefore, if you want to establish a long-term power of attorney, it may be best to start the process as soon as possible.
