Reasons for not being able to deliver include filing a bankruptcy petition before the sale is confirmed and returning the loan without the guarantor’s knowledge. If the validity of the sale is challenged by any party, the Trustee may, in its sole discretion, if it believes that the challenge is justified, request that the court declare the sale void and return the the bank account.
