A 36-year-old man was convicted last month of unlawful possession of a firearm for shooting another man in north Spokane this spring, while assault and drug charges against him were dismissed in court.
Spokane County Superior Court Judge Annette Pleas charged Steven M. with first-degree unlawful possession of a firearm, according to court records. Perry was sentenced to 51/2 years in prison. Defendant Perry pleaded guilty, while dropping a first-degree assault charge for the shooting and two counts of possession of a controlled substance with intent to deliver.
The sentence was in the middle of the standard sentencing range of 57 to 75 months.
The conviction stems from a May 20 shooting that killed 44-year-old Francisco Gutierrez with two gunshot wounds in a parking lot in the 6300 block of North Howard Street, north of Francis Avenue, according to court records.
Justin Anderson told deputies he drove Gutierrez to the lot to pick up a BMW 330 sedan from Perry for a debt, documents state.
As Gutierrez exited the vehicle driven by Anderson and approached the BMW, Perry opened fire on Gutierrez with a rifle.
Gutierrez ran through a nearby bank parking lot, got into a vehicle driven by Anderson, and the two drove to Providence Holy Family Hospital, according to records. He was taken to Providence Sacred Heart Medical Center, where Gutierrez was treated and released, hospital spokeswoman Arianna Lake said.
Authorities arrested Perry 12 days after a brief standoff with officers at a North Market Street apartment, according to a Spokane County Sheriff’s Office news release.
Perry’s criminal history includes burglary, theft, forgery, possession of stolen property and assault charges, according to records.
