Class Action Clinic has been awarded $3 million in unclaimed damages in a recent settlement.
“I was happy and relieved,” Jasminka Kalajdzic told CTV News Windsor. “Both because there are so many legal clinics in the state and nationally, funding is our number one concern.”
Kalajdzic is a law professor and director of the Class Action Clinic, which he says is the only one of its kind in North America.
“We help people from the beginning of the class process to the end. So far, we have been very successful. We have helped class members recover over a million dollars,” said Kalajdzic.
In this case, Kalajdzic says BMO Trust agreed to a $100 million settlement for undisclosed fees on foreign transactions.
$94 million was awarded to class members, and $6 million was not awarded.
“Instead of returning the money to the robber, it belongs to them [the court] donate the remaining funds to a non-profit or charity to do something that will indirectly benefit the class,” says Kalajdzic.
Because the Class Action Clinic was the only one, the plaintiff asked the court to give half of the money, and the other $3 million went to the United Way.
“It’s unfortunate for some class members, but we will use these funds now for the future to help as many class members as possible so they don’t lose these compensation claims,” said Kalajdzic.
The Class Action Clinic has an attorney who oversees all of the legal students’ work and earns academic credit for serving time.
And during the summer, the clinic hires student lawyers to work full-time on cases before the courts.
“Here [award] It puts us in a very good position,” said Kalajdzic.
