Alec Baldwin has filed a lawsuit to exonerate a 2021 movie-set shooting in New Mexico where the actor/producer accidentally killed a man after firing a prop gun loaded with live ammunition.
Mr. Baldwin’s cross-complaint, filed Friday in Los Angeles County Superior Court, alleges the negligence of multiple people in the shooting of cinematographer Halina Hutchins and director Joel Souza, who was injured on the set of the movie “Rust.” crime
Among those listed in the lawsuit are armorer Hannah Gutierrez-Reid, first assistant director David Halls, weapons and rounds supplier Seth Kenny, and property master Sarah Zachry, according to Law & Crime.
“These cross-defendants are professionals who owe a duty to Baldwin, including others, to keep the set safe,” the complaint states. “Everyone on set, including Baldwin, hoped and believed they would. Baldwin is seeking to clear his name and hold the cross-defendants accountable for their misconduct.
Mr. Baldwin is seeking some of the money he may have received from the same four defendants in his own lawsuit related to the shooting of script supervisor Mamie Mitchell. He is also seeking damages from the four if the case is successful.
But Ms. Mitchell’s lawsuit lists Mr. Baldwin as the lead defendant and alleges that the actor intentionally fired the gun.
“Mr. Baldwin chose to play Russian roulette with a loaded gun unchecked and unarmored,” the lawsuit alleges, according to Law & Crime. “His conduct at Rust and the conduct of the producers were willful acts and/or omissions without reasonable cause or excuse and with complete disregard for the consequences of said acts and/or omissions.”
The actor argued that the gun was safe and that he did not pull the trigger, but an FBI forensic report determined that the gun could not have been fired without the trigger being pulled.
The New Mexico Office of the Medical Investigator ruled the shooting an accident. Prosecutors are still reviewing the shooting to decide whether to file criminal charges.
