Nov 11 (Reuters) – Actor Alec Baldwin filed a lawsuit on Friday against the gunman and three other crew members in a fatal shooting on the set of the western movie “Rust” in which a gun Baldwin used during rehearsals killed cinematographer Halina. Hutchins.
Baldwin’s suit, filed in Los Angeles County Superior Court, is a cross-complaint from a previous suit in which another member of the crew named Baldwin and others as defendants.
It is one of several lawsuits stemming from the Oct. 21, 2021 disaster that is under criminal investigation and could result in New Mexico state charges.
Baldwin’s cross-complaint names costumer Hannah Gutierrez-Reid, first assistant director Dave Halls, prop supplier Seth Kenny and prop master Sarah Zachry. Attorneys for Gutierrez-Reid, Halls and Kenney did not immediately respond to requests for statements on their clients’ defense. Reuters could not locate a lawyer for Zachary.
All four, along with Baldwin, were named as defendants in the original lawsuit filed by the script supervisor, who claimed the shooting caused him severe emotional distress.
Baldwin’s cross-complaint alleges negligence and seeks damages at trial for the “great grief” he suffered.
“This tragedy occurred when live bullets were delivered to the set and loaded into the gun, Gutierrez-Reid failed to carefully inspect the cartridges or the gun, Halls failed to carefully inspect the gun, yet declared the gun safe before handing it over to Baldwin, and Zachary failed to disclose that Gutierrez-Reid was carelessly working on set and was a safety hazard to those around him,” Baldwin’s cross-complaint states.
The suit was written by Luke Nikas, Baldwin’s attorney with Quinn Emanuel.
Hutchins was killed while rehearsing Baldwin’s Revolver while filming in New Mexico.
In a televised interview, the actor said he did not pull the trigger of the Colt .45 revolver but fired it after cocking it.
An FBI forensic examination of the single-action revolver found that it “functioned normally” and would not fire without pulling the trigger.
